Terms of Use and Disclaimer - Holymp

This document (“Terms”) governs use of the Holymp app and related services (together, the “Service”).
The Privacy Policy is a separate document and describes how we process personal data: https://privacy.holymp.app/en/.

By using the Service, even without registering, you confirm that you have read and understood these Terms. If you do not accept them, do not use Holymp.

3) Purpose and Nature of the Service (Fitness / Wellness)

Holymp provides digital support tools for fitness/wellness, workout, and nutrition tracking, such as diaries, statistics, planning, estimates, and summaries.

Holymp is not a medical device and does not diagnose, treat, cure, or prevent any medical condition.
The Service does not provide healthcare services, clinical diagnoses, treatments, emergency management, telemedicine, professional nutritional advice, or professional personal training services.

4) Age Requirements and Eligibility

For Italy, use of the Service is permitted only to people aged 14 or older.
Users under 14 may not use Holymp or create an Account.

Holymp may request, during registration or later, information to verify the declared age and may block access in case of false declarations or age below the threshold.

5) Registration, Account, and Credential Security

5.1 Account Creation

Access to certain features may require creating an Account, such as email/password and login through third-party providers like Google.

The User agrees to:

You are responsible for every activity carried out through your Account and agree to keep your credentials confidential.
If you suspect unauthorized access, you must contact us without delay at info@holymp.app.

The User remains responsible for prudent use of the app, verification of entered information, and decisions made based on summaries, estimates, suggestions, or outputs generated by the Service.

5.3 Suspension and Closure

We may suspend or close the Account, or limit access to the Service, if this is reasonably necessary, in particular in case of:

We may act without notice only when necessary, for example for security reasons, to prevent abuse, fraud, or harm to the Service, to third parties, or to comply with legal obligations.

If the Account is managed in-app, Holymp provides a deletion path:

8) User Content: Responsibility, License, and Moderation

8.1 Responsibility

The User is solely responsible for User Content entered or uploaded and guarantees that they have the necessary rights.

8.2 Technical License Granted to Holymp

By entering User Content, you grant Holymp a non-exclusive, worldwide, free license, limited to the time necessary, to host, store, process, reproduce, and make that content available only to:

We may remove User Content or limit its use if we believe, including in good faith, that it violates the Terms or the law, or creates risks for the Service or third parties.

9) Intellectual Property and License to Use

Holymp, the Content, and all associated intellectual property rights, including software, trademarks, UI, databases, text, and graphics, are owned by the Provider or their respective licensors.

The User is granted a personal, non-exclusive, non-transferable, revocable license to use the App and the Service under these Terms. Any other use is prohibited and may be pursued under applicable law.

10) AI, Premium, and AI Coach Features: Limits, Warnings, and Verification

AI, Premium, and AI Coach features may generate errors, inaccurate estimates, incorrect classifications, or suggestions that are not suitable for the individual case.

The User acknowledges and accepts that:

11) No Medical, Nutritional, or Professional Advice and Physical Activity Risk

The Service content, estimates, and suggestions, including AI, Premium, or AI Coach outputs, are for informational purposes and do not replace advice from a doctor, nutritionist, dietitian, personal trainer, physiotherapist, or other qualified healthcare professional.

In case of medical conditions, pregnancy, injuries, pharmacological therapies, symptoms, or clinical doubts, consult a healthcare professional before following indications from the Service.

The User declares:

12) No Emergency Use

Holymp must not be used for medical emergencies.
In case of emergency, immediately contact emergency services, such as 112 in Italy, or the competent authorities.

13) Availability, Updates, and Changes to the Service

The Service may be subject to interruptions, maintenance, changes, updates, or suspensions, even without notice, for technical, security, legal, or organizational reasons.

We may update the App to:

14) Payments, Subscriptions, AI Coach Credits, and Premium Features

Some Premium features may be inactive, available only for certain accounts, or subject to technical and store configurations.

Holymp may offer:

AI Coach credits are consumable: once they are used for the intended feature, the balance is reduced. For example, 1 credit allows 1 extra AI Coach generation, in addition to any credits included with Premium.

On Android, payments are handled through Google Play Billing, unless otherwise indicated. Price, duration, billing period, any free trial, and main conditions are shown before purchase and in the payment flow screens.

The user can manage, cancel, or stop automatic subscription renewal from their Google Play account settings. Refunds, disputes, and payment issues are handled according to the rules and procedures of the relevant store, without prejudice to applicable law.

AI Coach credits are not money, cannot be converted into money, and cannot be transferred between accounts, unless mandatory law or applicable store rules require otherwise.

Price Changes

Prices for subscriptions, credits, and other paid features may change in the future. Any promotional or launch price is not guaranteed indefinitely.

For new purchases, the updated price will be shown before payment.

For active subscriptions, any price increases will be communicated according to store rules and applicable law. Where store rules or applicable law provide for it, the user may decline the increase, cancel, or stop renewal before the new price applies.

If acceptance is required and is not given, the subscription may fail to renew or may end according to store rules.

15) Mandatory Consumer Rights

If you use the Service as a consumer, mandatory rights provided by applicable law remain unaffected, including the Italian Consumer Code and rules on digital content/services.

No clause of these Terms limits or excludes those rights where this is not permitted by law.

16) Limitation of Liability (Within Permitted Limits)

To the maximum extent permitted by applicable law, the Provider is not liable for:

Liability remains unaffected in cases that cannot be excluded by law, such as willful misconduct or gross negligence and other mandatory cases.

17) Force Majeure

The Provider is not responsible for delays or failures due to events outside its reasonable control, such as infrastructure failures, blackouts, third-party service disruptions, cyberattacks, authority measures, or natural events.

18) Changes to the Terms

We may update these Terms. The current version is published at:

In case of substantial changes:

If you continue to use the Service after updates enter into force, you accept the updated Terms, unless the law requires different methods.

19) Applicable Law and Competent Court

Applicable law: Italian law.

20) Final Clauses

If a clause is held invalid or ineffective, the remaining clauses remain valid.
Failure to exercise a right does not constitute waiver.
